    (hereinafter referred to as “Client”) and Megan Cavassa acting as agent for Speak Fido Dog Training (hereinafter known as “Trainer) pertains to the following:
    (hereinafter referred to as “Dog”)
    Speak Fido Dog Training – Waiver and Training Contract(Required)
    Training Fees:
    Client agrees to pay Trainer a nonrefundable fee in the amount of $150 for a package of 6 sessions to be paid at first session. All sessions must be completed within 6 months from the date of commencement of contract or they will be forfeited.

    Dog Health and Vaccinations:
    Client warrants that Dog is physically fit and in good health, and free of fleas, parasites and infections diseases. Client must provide proof of vaccines prior to participating in group classes.

    Training Services:
    Trainer agrees to provide group lessons for Client and Dog on a lesson-by-lesson basis, the goal being to teach Client how to train and work with Dog. Trainer will make every reasonable effort to help Client achieve training and behavior modification goals but makes no guarantee of Dog’s performance or behavior as result of providing professional animal behavior consultation. Client understands that he/she and members of the household must follow Trainer’s instructions without modification, work with Dog daily as recommended and constantly reinforce training being given to Dog.

    Cancellation Policy:
    If Client fails to give at least 24 hours cancellation notice, or is not present at time of scheduled appointment, session fees are still due. For a package deal the session will still be counted as one session.

    Release of Liability and Indemnification:
    Client expressly acknowledges and understands that Trainer’s services will be provided in an environment where certain hazards may exist, including, but not limited to, debris in the training area, other animals and their owners, training equipment, water and other natural hazards. Client expressly agrees to indemnify Trainer and Trainer’s agents from any claims, demands, lawsuits, losses, costs or expenses, including attorney fees, arising out of or in connection with the provision of Trainer’s services to Client and/or Dog.

    If Dog causes property damage, or bites or injures any dog, animal or person (including but not limited to Trainer and Trainer’s agents) during or after the term of this Agreement, then Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify Trainer and Trainer’s agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If Dog is injured in a fight or in any other manner during or after the term of the Agreement, Client assumes the risk and agrees that Trainer should not be held responsible for any resulting injuries, losses, damages, costs or expenses.

    At Trainer’s sole election, Trainer’s duties hereunder shall terminate if (a) in Trainer’s sole judgment Dog is dangerous or vicious to Trainer or any other person or animal, or interferes with the training of other dogs, or (b) Client breaches any term or condition of this Agreement. Upon termination in accordance with the forgoing, Trainer’s duties shall terminate but all other provisions of this Agreement shall continue in full force and effect.

    This Agreement is binding upon Client, spouse of Client, and children of Client. This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Client and Trainer regarding the matters described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to Dog or anything else. Without limiting the generality of the forgoing, Client acknowledges that Trainer has not represented, promised, guaranteed or warranted that Dog will never bite, that Dog will not be dangerous or vicious in the future, that Dog will not exhibit other behavioral problems, or that the results of the training will last for any particular amount of time. This Agreement may be amended only by a written instrument signed by both Client and Trainer.

    Photo Release:
    Client grants to Trainer, and/or its representatives and employees, the right to take photographs of Client and/or Dog, and to copyright, use and publish the same in print and/or electronically. Client agrees that Trainer may use such photographs of Client and/or Dog with or without my name and for any lawful purpose, including for example, such purposes as publicity, illustration, advertising and Web content.
    Wenatchee Valley Humane Society – Waiver of Liability and Informed Consent Release(Required)
    I, the undersigned hereby acknowledges that I am voluntarily participating in training classes located at Wenatchee Valley Humane Society and offered by a third-party trainer. Because dogs are animals and may be unpredictable, Wenatchee Valley Humane Society cannot protect against potential injury, risk or accident. This Release and Waiver are intended to shift the risk of participating in dog training to the Participant/Owner/Guardian of the dog participating in training. I acknowledge that i have had full opportunity to discuss any and all concerns I have regarding foregoing risks with Wenatchee Valley Humane Society and its authorized representatives.

    Participant agrees to hold harmless Wenatchee Valley Humane Society from any and all claims of injury, loss, expenses, or damage caused by the actions of Participant’s dogs or other participating dogs during the course of training. I hereby accept and assume. without reservation, all risks associated with my participation in the training program, including, but not limited to: the risks of any and all zoonotic diseases or injuries to myself, mu dog and any of my family members or third parties who may attend: the risks that my dog may cause injury to other persons and/or dogs involved: and the risks that saliva, water, food, and/or other debris may be present in the training area. I have read and understand Wenatchee Valley Humane Society, and agree to abide by them.

    As lawful consideration for participating in the training program, I, of myself, my heirs, next of kin, executors, administrators, legal representatives, successors, and assigns (the “Releasing Party”), hereby waive, release, discharge and covenants not to sue and to indemnify, defend and hold harmless Wenatchee Valley Humane Society, and their members, managers, agents, and employees (the “Released Party”) from any and all injuries, losses, claims and damages to any person or persons of any nature its directors, officers, employees, agents, sponsors, organizers, volunteers, or other representatives, their successors and/or assigns, (hereinafter collectively the “Releases”) from any and all liability to the Undersigned for any loss, harm, damage, clam, injury or accident to the person or property of the Undersigned, whether caused by any ordinary negligent act or omission or the Releases while the Undersigned or his/her dog is engaged in or participating in dog training or using any Trainer or Business facilities in connection therewith.

    This Waiver of Liability & Informed Consent Release shall be legally binding on the Releasing Party. Further, Should the Releasing Party assert a claim to the contrary to what i have agreed to in this Waiver of Liability and Informed Consent Release, the claiming party shall be liable for the expenses (including attorney’s fees, court costs and consultant fees) incurred by both the Releasing Party and the Released Party. No waiver or modification of any provision herein shall be valid unless expressly agreed to in writing by both the Released Party and the Releasing Party.

    I hereby consent to my dog being the subject of the photographs and/or audiovisual recording and authorize Wenatchee Valley Humane Society the same to be exhibited for educational purposes of marketing tools as still photographs, videos or other similar media.

    Every provision herein is intended to be severable. If any on or more of the provisions herein is found to be unenforceable or invalid, that shall not affect that other terms and provisions hereof, which shall remain binding and enforceable. This foregoing release and waiver, and assumption of risk is intended to be as expansive, broad and inclusive as permitted by Washington law.
